These Terms & Conditions ("Terms") govern your booking and stay at Kingston Apartments properties located at Long Mountain Country Club, Kingston, Jamaica. By making a reservation, you agree to be bound by these Terms in full.
1. Booking & Payment
- All reservations require full payment at the time of booking to confirm your stay. No reservation is confirmed until payment has been received and processed.
- Payments are processed securely through PayPal or other third-party payment providers. Kingston Apartments does not store your credit card or payment details.
- Prices are listed in US Dollars (USD). You are responsible for any currency conversion fees charged by your bank or payment provider.
- Quoted rates include accommodations only. Any applicable taxes, service charges, or fees are displayed at checkout before payment.
- A booking confirmation with a unique reference number will be provided upon successful payment.
2. Damage Deposit
- A $100 USD damage/security deposit is collected in cash upon check-in.
- The deposit will be returned in full at check-out, provided there is no damage to the property, missing items, or excessive cleaning required beyond normal use.
- If damages or losses exceed the deposit amount, the guest agrees to pay the difference. The host reserves the right to charge any additional costs to the payment method on file or pursue recovery through other means.
3. Cancellation Policy
- More than 14 days before check-in: Full refund minus a $25 USD administrative fee.
- 7 to 14 days before check-in: 50% refund of the total booking amount.
- Less than 7 days before check-in: No refund.
- No-shows: No refund will be issued for failure to arrive on the scheduled check-in date without prior notice.
- All cancellation requests must be made in writing via email or WhatsApp. The cancellation date is determined by when the request is received, not when it is sent.
- Refunds, where applicable, will be processed within 7-14 business days through the original payment method.
4. Check-In & Check-Out
- Check-in: 3:00 PM onwards. Early check-in may be available upon request but is not guaranteed.
- Check-out: 11:00 AM. Late check-out may be available upon request and may incur additional charges.
- Guests must present valid government-issued photo identification at check-in.
- Key handoff and check-in instructions will be communicated prior to arrival via email or WhatsApp.
5. House Rules
- No smoking inside the apartment. Smoking is permitted on the balcony/terrace only. A cleaning fee of $150 USD will be charged for smoking violations indoors.
- No parties or events. The properties are located in a quiet residential community, and noise must be kept to a minimum, especially between 10:00 PM and 7:00 AM.
- No pets unless expressly agreed upon in writing prior to booking.
- Maximum occupancy must not exceed the number of guests declared at the time of booking.
- Guests are responsible for keeping the property clean and tidy during their stay. Excessive cleaning beyond normal use will result in a cleaning fee deducted from the damage deposit.
- All garbage must be disposed of properly in the designated bins.
- The property is within a gated community. Guests must comply with all community rules and regulations, including pool hours, parking, and noise guidelines.
6. Guest Responsibilities
- Guests are responsible for the security of the property during their stay, including locking doors and windows when leaving.
- Any damage, breakage, or loss of property items must be reported immediately to the host.
- Guests are responsible for their own personal belongings. Kingston Apartments is not liable for any theft, loss, or damage to guest property.
- Guests must not engage in any illegal activities on the premises.
- Any additional guests or visitors must be approved by the host in advance.
7. Liability & Disclaimers
- Kingston Apartments provides the property on an "as is" basis. While we strive to ensure all amenities and facilities are in working order, we do not guarantee uninterrupted services including but not limited to electricity, water, internet, or air conditioning due to factors beyond our control.
- Kingston Apartments shall not be liable for any direct, indirect, incidental, or consequential damages arising from your stay, including but not limited to personal injury, property damage, illness, or any disruption caused by natural disasters, utility outages, construction noise, or third-party actions.
- Guests use all facilities (including the community pool, parking areas, and common areas) at their own risk.
- Kingston Apartments is not responsible for any injuries sustained on the property or within the community grounds.
- In the event of circumstances beyond our control (force majeure), including but not limited to natural disasters, pandemics, government actions, or civil unrest, Kingston Apartments reserves the right to cancel bookings. In such cases, a full refund or rescheduling options will be offered.
8. Privacy & Data
- Personal information collected during the booking process (name, email, phone, etc.) is used solely for booking management, communication, and improving our services.
- We do not sell, rent, or share your personal information with third parties, except as necessary to process payments or comply with legal requirements.
- Payment processing is handled by third-party providers (PayPal). Their use of your data is governed by their own privacy policies.
9. Modifications to Booking
- Date changes are subject to availability and must be requested at least 7 days before the original check-in date.
- Any rate differences resulting from date changes will be charged or refunded accordingly.
- Kingston Apartments reserves the right to relocate guests to a comparable property in the event of unforeseen circumstances (e.g., maintenance emergency). In such cases, guests will be notified immediately and offered a full refund if the alternative is not acceptable.
10. Governing Law & Disputes
- These Terms shall be governed by and construed in accordance with the laws of Jamaica.
- Any disputes arising from these Terms or your stay shall first be attempted to be resolved amicably through direct communication. If no resolution can be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.
11. Changes to These Terms
Kingston Apartments reserves the right to update or modify these Terms at any time. Changes will be posted on this page with the updated date. Guests are encouraged to review these Terms before each booking.
